The terms of access to and use of the D-⁠Money electronic money services.

1.Publisher and purpose

These General Terms and Conditions of Sale (the “Terms”) govern access to and use of the electronic money services offered under the trade name D-⁠Money (“D-⁠Money”), which is supervised by the Central Bank of Djibouti (“BCD”).

The D-⁠Money website is for information purposes only. Subscription to the services is carried out exclusively through the D-⁠Money mobile application (customer or partner) or at authorised D-⁠Money branches. Any subscription implies full and unreserved acceptance of these Terms.

2.Definitions

  • User: any person holding a Mobile Money Account, whether a Customer or a Partner.
  • Customer: an individual using the D-⁠Money mobile application for personal needs.
  • Merchant: a User accepting payments in return for the sale of goods or services.
  • Distributor / Sub-distributor: a User authorised by D-⁠Money to receive Customers’ deposits, allow them to withdraw their funds and sell airtime.
  • Partner: a Merchant, Distributor or Sub-distributor.
  • EVU: Electronic Value Unit, representing the electronic money issued by D-⁠Money.
  • Mobile Money Account: an individual account intended for receiving and storing EVUs.
  • Mobile Money Agreement: the contract between D-⁠Money and the User, comprising these Terms, the terms of use of the relevant application, the Price List and the Privacy Policy.
  • Price List: the document setting out the fees and commissions applicable to the services.

3.Services offered

3.1 Services for Customers

  • Crediting the Mobile Money Account with EVUs, by top-up or by a transfer of EVUs received from another User;
  • Debiting the Mobile Money Account in EVUs, on the User’s transfer order or by cash-out;
  • National and international money transfers;
  • Bill payment (Djibouti Telecom, ONEAD, EDD, University of Djibouti);
  • Airtime top-ups;
  • Bank interconnection (deposits and withdrawals between the D-⁠Money wallet and the User’s bank account);
  • Secure online payments;
  • Electronic wallet management, transaction history and real-time notifications.

3.2 Services for Merchants

  • Receiving payments for goods and services sold;
  • Bank interconnection, electronic wallet management and online payments;
  • National and international transfers, purchase of mobile airtime;
  • Withdrawal of available funds.

3.3 Services for Distributors and Sub-distributors

  • Crediting and debiting the Mobile Money Account in EVUs;
  • Receiving Customers’ deposits and processing their withdrawals;
  • Selling airtime and paying bills;
  • Bank interconnection, national and international transfers, electronic wallet management, transaction history and real-time notifications.

D-⁠Money may change the range of services offered. The services available are those displayed in the application on the day of the transaction.

4.Opening an account

4.1 Customers

Opening a Mobile Money Account is free of charge and takes place at D-⁠Money points of sale. The Customer presents a valid identity document (national identity card or passport) and fills in the form provided by the D-⁠Money branch.

The account is activated by SMS within 24 hours of registration.

4.2 Partners

Registering a Partner requires the trading licence (patente), the manager’s identity card and a recent identity photograph of the manager. These documents are checked and approved by D-⁠Money before any activation.

4.3 Verification

D-⁠Money reserves the right to refuse to open an account, to request any additional document and to carry out any verification required by regulations, in particular regarding anti-money laundering and countering the financing of terrorism (AML/CFT). The User guarantees the accuracy of the information provided and undertakes to keep it up to date.

5.Nature and operation of the Mobile Money Account

The Mobile Money Account is intended exclusively for receiving and storing EVUs. It cannot hold any other security, transferable security or financial instrument, nor any sum of money in any currency or monetary unit whatsoever. It is an individual account reserved for Users with mobile access.

The opening, operation and maintenance of the Mobile Money Account are subject to the laws in force in the Republic of Djibouti and in the other countries concerned by the transactions, in particular monetary, tax, international financial relations, embargo, anti-corruption, anti-money laundering and counter-terrorist financing laws, as well as to the applicable ethical and prudential rules.

For a credit transaction, the Mobile Money Account is credited immediately on the instruction of the third-party payer.

6.Prices and fees

The fees applicable to the services and, where applicable, the Partners’ commissions are set out in the Price List, available in the application. Prices are expressed in Djibouti francs (DJF).

The User expressly authorises D-⁠Money to debit their Mobile Money Account with a quantity of EVUs equivalent to the nominal amount of the fees due.

D-⁠Money may change its prices. Users are informed by notification in the application or by email before the new prices take effect; they apply to transactions made after that date.

7.Security and User obligations

Access to the services is secured by facial recognition, fingerprint and two-factor authentication with a one-time password (OTP).

The User is solely responsible for keeping their credentials confidential and for the operations carried out with their account. The User must not disclose them to third parties and must report to D-⁠Money without delay any loss, theft, fraudulent use or suspicious activity. D-⁠Money cannot be held liable for losses resulting from unauthorised access attributable to the User’s failure to meet these obligations.

8.Prohibited uses

The User undertakes to comply with the applicable laws and regulations. In particular, the User must not:

  • use the services for illegal, fraudulent or abusive purposes;
  • circumvent security measures or attempt to hack the application;
  • transfer, sell or make access to their account available to third parties.

9.Personal data

D-⁠Money collects and processes the User’s personal data (identification information, transaction data, biometric authentication data) to provide and improve the services, ensure the security of transactions, prevent fraud and comply with its legal and regulatory obligations. The terms of processing, sharing and retention, as well as the User’s rights (access, rectification, deletion, objection, withdrawal of consent), are set out in the D-⁠Money Privacy Policy, which forms an integral part of these Terms.

10.Liability

D-⁠Money cannot be held liable for indirect, special or consequential damages resulting from the use of the services, including loss of profits, data or use. D-⁠Money is not liable for service interruptions due to force majeure, a failure of telecommunication networks or maintenance operations.

Merchants remain solely responsible for the compliance and proper performance of sales of goods and services paid for with D-⁠Money.

11.Term, suspension and termination

The Mobile Money Agreement is entered into for an indefinite period. The User may terminate it at any time by requesting the deletion of their account, at the D-⁠Money main branch or by email to contact@d-money.dj: the account is deleted within 48 hours of sending the request. D-⁠Money may suspend or close an account without notice in the event of a breach of these Terms, suspected fraud, failure to meet legal obligations or for security reasons.

In the event of the User’s death, the EVUs held in the Mobile Money Account are frozen until the legal or judicial settlement of the estate is completed.

12.Statements and transaction tracking

The User can obtain a statement of their Mobile Money Account at any time from their mobile phone and track their transactions by contacting the Customer Care Centre. No printed statement is provided.

13.Complaints

Any complaint may be sent to D-⁠Money customer service on 25 25 or to contact@d-money.dj. D-⁠Money undertakes to review it as quickly as possible.

14.General provisions

The Mobile Money Agreement binds the User, their successors and assigns. The User’s rights and obligations cannot be transferred to a third party. D-⁠Money may subcontract all or part of its obligations, for which it remains responsible.

A party’s failure to exercise a right does not constitute a waiver of that right. The rights provided by the Mobile Money Agreement are cumulative and do not exclude rights provided by law.

15.Changes to the Terms

D-⁠Money may change these Terms at any time. Changes are published on the website and notified in the application. Use of the services after they take effect constitutes acceptance of the amended Terms.

16.Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Djibouti. Any dispute relating to their interpretation or performance falls under the exclusive jurisdiction of the courts of Djibouti.
